Our Terms & Conditions
1) Definitions & Law
The contract is the document or documents that set these conditions and all other details about the agreement between the customer (client) and the supplier of goods or services (Simple Wedding Films - SWF). "EVENT" means the service you have booked. These conditions will be governed by and interpreted in accordance with the Scottish law. These conditions do not affect the statutory rights as a consumer as defined by the "Unfair Contract Terms act 1977 or any statutory amendments of that act.
2) Rights reserved
Any failure by SWF not to enforce any or all of these conditions shall not amount to or be interpreted as a waiver of any of SWF’s rights. By booking SWF for an event you are accepting these terms & conditions.
3) Special Requests/Coverage
The client understands and accepts that the video coverage will be as the videographer's professional expertise determines and that no one shot/scene will be deemed more important than another. Special requests are not binding instruction, although every effort is made to comply with the client’s wishes.
4) Limit of our liability.
SWF will not be liable for any delays caused by circumstances, which are beyond their reasonable control. SWF will not be liable for any radio signal losses, battery failures, equipment failure and or material defects, which are beyond their control. Any refunds for the EVENT will be limited to no more than the original sums involved. In the unlikely event of a total video failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
5) Force Majeure or Act of God
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
6) Cancellations
The client may cancel this contract at any time by giving written notice to the SWF but in doing so shall forfeit any monies paid. Should SWF receive cancellation less than 8 weeks prior to the date of the ceremony, the client shall in addition pay a sum equal to 100% of the contract value less the booking fee. The said sum shall be payable as compensation as an estimate of the loss SWF would suffer.
7) Booking Fee
A non-refundable booking fee is charged when the client submits their booking form, this fee is deducted (in full) from the TOTAL price.
8) Payments
Any balance owing shall be payable four weeks before the event, unless otherwise agreed.
9) Copyright / Display
The copyright of the goods will remain with SWF. The client hereby allows SWF to display any images/video included in this contract in their studios, portfolios, literature, wedding exhibitions, social media and advertising.
10) Errors/Changes
Any errors or defects on the USB supplied, which is the fault of SWF will be remedied free of charge otherwise any other corrections if possible, will be altered at their discretion. By booking the film with us you are agreeing to let SWF film and edit using their judgment & artistic licence. The client in relation to the material, locations used and final editing, shall grant the videographer artistic licence. The client PRIOR to the event shall deem the Videographer judgment regarding locations and final editing correct unless previously discussed with the client and agreed in writing.
11) Complaints
Any complaints should be raised by the client with SWF, in writing, within 28 days of first becoming aware of the matter to be complained off and in any event within 28 days on receipt of the goods. If the event is a commercial activity then any complaints should be raised within 5 days of the event.
12) Photos / Music
Any items sent to SWF must be labeled with the reference number on the booking form with your name and return address. Whilst every care is taken, customer’s material is accepted on the basis that their value does not exceed the retail cost of the material itself. Liability for loss or damage is therefore limited to the replacement of such material. Any alterations to the Event to be put in writing and sent to SWF to arrive not later than 48 hours before the day of the Event.
13) Videographer requirements
If the videographer/s are filming for longer then 6 hours then some hot food must be provided.
14) Non Attendance / Videographer
If, for whatever reason, the videographer is late or does not turn up, then you MUST phone the office immediately on 0785 495 6677 so a replacement can be organised. On occasions and without notice it may be necessary for the videographer originally specified to be substituted by another videographer, (e.g. due to ill health).
15) Colours / Lighting / Sound
While every effort will be made to ensure accurate colours and lighting reproduction, in certain conditions the colours and the lighting may not be accurately reproduced. This is not a fault but a limitation of the factors on the day, which are beyond the control of SWF e.g. mixed indoor & external lighting, harsh shadows, and poor lighting conditions. Sound will be captured as accurately as possible within the limitations of the event and the equipment used.
16) Camera Positions / Authority / Permissions to Video
While every effort will be made to get the best position for the camera to video the event. Due to restrictions imposed upon SWF on the day, this may not always be possible. The client must obtain permission to film at the appointment location (church, park, hotel etc.) from the relevant authorities, and the client is responsible for any fees that may be levied by such authorities. SWF will not be responsible for any refusal by such authorities to allow filming to be carried out.
17) Completion / Delivery / Postage
Completion is usually within 8 weeks from the date of the event (not including any bank holidays). The video, music & any photographs should be ready to collect after this period. If all the information and items required to complete the video are not with SWF by at least the event date then the 8 weeks does not apply, editing will then be done when possible at the discretion of SWF. If the completed video is required to be posted the client must inform SWF of the delivery address. The delivery will be standard post only (please bear in mind the value of the photographs & music). The postage will be borne by us for this copy only. If after 6 months from the date of the event, the materials and, or information required to finish the video is not forthcoming, then the service will have expired and a charge made for any subsequent editing.
18) Rights
These Conditions do not affect the statutory rights of the client.
